Certifiers, council and building disputes in Austral NSW

Austral sits in the City of Liverpool. Your construction certificate and the mandatory inspections that go with it come from a principal certifier, and it is worth being blunt about what those are for: they allow the certificates to issue. They are not carried out for you and they do not produce a defect list. Your actual protection is elsewhere, in the statutory warranties under the Home Building Act 1989, six years for major defects and two for the rest, and in the Home Building Compensation Fund through icare where a builder cannot finish. Disputes go to NSW Fair Trading first, then to NCAT.

Certifiers, council and building disputes in Austral NSW: common questions

Is the certifier's inspection enough?

No. Its function is to establish that the work satisfies the certificate at nominated milestones. It will not tell you the cover is short or a column is the wrong section, and it is not done in your interest.

What counts as a major defect?

Broadly a defect in a major element that makes the home uninhabitable or unusable for its purpose, or threatens collapse. The category decides whether you have six years or two.

Where does a complaint start?

In writing with the builder. If that fails, NSW Fair Trading's complaint and inspection process, and NCAT after that.
